The Federal Trade Commission’s Identity Theft Red Flags Rule went into effect on December 31, 2010. Despite this deadline, many organizations are still uncertain as to whether the Rule applies to them and what their compliance obligations are with respect to developing an identity theft prevention program. Compliance with the Rule is further complicated by the fact that the  Rule does not tell a company what its identity theft prevention program must include, but merely sets forth the process that organizations have to follow to establish their own specific program.
 
This webinar is presented by Boris Segalis, a partner at InfoLawGroup LLP, a law firm specializing in privacy, information security, technology and intellectual property. Mr. Segalis is a noted privacy law expert. He has written extensively about the Red Flags Rule and advised clients in a variety of industries on compliance with the Rule. Mr. Segalis will help organizations determine whether they are subject to the Red Flags Rule and will review what steps they must take to implement the Rule’s requirements. The presentation will cover the text of the regulation, federal agency guidance and newly-enacted legislation that limits the Rule’s application. The webinar will provide guidance to organizations regarding the steps they must take to comply with the Rule, including the development, implementation and ongoing administration of an identity theft prevention program. Finally, Mr. Segalis will review enforcement of the Rule by federal agencies.
