There are a number of sound business reasons to engage
independent contractors and commendable public interest
considerations in offering unpaid internships.
There are, however, significant risks to employers who do
so, if these individuals are determined to be employees under
various federal and state statutes.
The US government and state officials are vigorously
pursuing employers who misclassify workers as independent
contractors or interns.
Employment attorney Mel Muskovitz will guide you through
the many rules that govern the issue of who is an employee and
who is not.
This program has been pre-approved for 1.5 hours of General recertification credit

Mel Muskovitz, a partner in Dykema Gossett PLLC, represents
businesses, governmental units and not-for-profit organizations
in labor and employment matters.
His practice includes defending employers in
discrimination, wrongful termination, wage and hour, contract
disputes including non-compete agreements, and other
employment-related disputes in state and federal courts and
before administrative agencies.
Mr. Muskovitz devotes a substantial portion of his time
assisting his clients in avoiding legal problems by preparing or
reviewing employment contracts, restrictive covenant agreements
and employee handbooks, conducting training, advising on
appropriate preventative measures and assisting with day-to-day
employment issues including employee discipline and compliance
with the Fair Labor Standards Act, the Family and Medical Leave
Act, the Americans with Disabilities Act and Title VII of the
Civil Rights Act of 1964.

(Labor and Employment Law) for 2009-2012 by U.S. News and World
