Description

The standard discipline process requires pre-disciplinary investigation of performance problems, harassment, work rule violations, retaliation or other workplace misconduct. Complaints about your employees from your clients or customers or from fellow employees require prompt and thorough investigation. HR managers are often called upon to conduct investigations but aren’t given adequate training to do an effective investigation. Employees who are disciplined after an investigation have legal rights and often appeal to government agencies or sue their employer. How the investigation was performed often becomes the subject of legal challenge. Personal liability for the investigator may occur if the investigation is not handled properly.

This webinar covers the legal and practical aspects to ensure a fair and valid internal investigation of matters that may require disciplinary action. The program covers practical techniques of planning fact finding, interviewing witnesses, and documenting your investigative findings. Special emphasis is given to issues related to confidentiality, invasion of privacy, defamation and what you should and should not do to prevent personal liability for just doing your job.

    Bob Gregg, Boardman & Clark Law Firm in Madison, Wisconsin, has been involved in employment relations for more than 30 years.  He litigates employment cases, representing employers in all areas of employment law.  His main emphasis is helping employers achieve enhanced productivity, creating positive work environments, and resolving employment problems before they generate lawsuits.  He has designed the anti-harassment, bullying and violence policies and procedures of numerous employers.  Bob has conducted over 3,000 seminars throughout the United States and authored numerous articles on practical employment issues.  He is a member of the Society for Human Resource Management, the National Speakers Association, is a National Faculty Member of the American Association for Access, Equity & Diversity and served on the Board of Directors for the Department of Defense Equal Opportunity Management Institute Foundation.
