Description

During the first six months of the Biden Administration, we have already witnessed a dramatic ramping up of regulatory activity.  President Biden has issued dozens of executive orders, essentially nullifying the Trump legacy and instituting a new cycle of employee-rights regulation.

President Biden’s Department of Labor almost immediately rescinded the independent-contractor regulations that had only become final in early January.  We can be reasonably sure that the next step will be to embrace California’s ultra-tough “ABC” test of independent-contractor status.

The President also has signaled his intention to move the minimum wage to $15/hour.  In furtherance of that goal, he already has mandated that early next the hourly minimum for federal contractors’ employees will climb from the current $10.45 to $15.00.

We should be bracing ourselves for more stringent Wage & Hour division enforcement of mis-classification cases involving exempt v. non-exempt employees, as well as overtime and waiting time regulations.  Further, for those of us who will continue to maintain a high level of remote work, time records remain a major challenge.

With 20 published books, mostly on HR-law topics, he teaches HR compliance in Drexel University’s Kline School of Law and is president of his own consulting company.
