Employers have always needed to monitor employees due to employee theft, fraud and inappropriate behavior.  This need suddenly has assumed new urgency in 2020.  Due to the pandemic, telecommuting has become the new norm.  Having your employees work from home may be the best--- perhaps the ONLY --- way to stay in business, both right now and whenever the pandemic reoccurs as the experts predict.  Thanks to modern technologies, it may be fully feasible to run your organization in this decentralized way, perhaps even indefinitely.

But… this means the challenge of monitoring employees’ efficiency and honesty is both more urgent and more difficult than ever before.  Face-to-face meetings have been displaced by Zoom, Skype, Microsoft Team, and Facetime conferences and consultations.  But are those ostensibly confidential conferences really secure?  Recent incidents involving school districts as distant from one another as New York City and Clark County (NV) suggest that hackers have been quick to catch onto eavesdropping on such “confidential” teleconferences.

And… hackers may not be the only, or even the major threat.  Your own employees now have unique opportunities and tantalizing temptations, ranging from fudging time records to misappropriating your trade secrets.  Monitoring your telecommuters is absolutely crucial to the integrity of your enterprise.

But…  you can’t cross the line by violating employee privacy rights.  You need to find the right balance between your rights and theirs. This difficult balance requires having policies in place and operationalizing them in ways that protect the organization without breaking the law.  How can you walk this legal tightrope and keep your organization secure?
