Though health experts tell us that while COVID-19 remains a serious concern, we are beginning to turn the corner. Employers are preparing for the challenges ahead and their employees are looking forward to a return to work. There is a good deal of uncertainty, however, concerning what the “new normal” will look like for businesses and employees.

HR will be at the forefront dealing with these employee-related uncertainties, many of which will pose significant and even new regulatory compliance challenges. For example, can an employer compel returning workers to be tested, how about periodically retesting employees, what about providing personal protective equipment, how to bring back furloughed workers and deal with changes in compensation, continuing social distancing policies, how do expanded family medical leave and paid sick leave fit in, different practices for younger and older employees, potential privacy violations as HR collects needed health information, and more.

Dr. Jim Castagnera, Esq. is a sought-after speaker and teacher, successful author, and accomplished consultant who assists his clients in meeting their current HR compliance challenges with clear and practical solutions. He holds a JD and a PhD from Case Western Reserve University. Following ten years as an employment and labor lawyer with a major Philadelphia law firm, he served for 23 years as in-house legal counsel at Rider University. With 20 published books, mostly on HR-law topics, he teaches HR compliance in Drexel University’s Kline School of Law and is president of his own consulting company.
