COURSE DESCRIPTION: How good is your company at writing job descriptions? If you’ve ever been sued, you know they’re among the first things plaintiffs’ attorneys demand. And you know that a lot of discrimination, harassment and ADA cases turn on what’s in them.   

Job descriptions are legal documents required for performance management, performance documentation and liability-free termination. Yet most companies find it impractical to run them by legal counsel. What’s worse, many HR executives and line managers aren’t skilled at writing them. This despite the fact that rock-solid job descriptions are one of the best ways to stay out of court (and ensure victory should you ever get sued). 

At the end of this course, participants will be able to: 

  • Describe the four critical elements every job description needs at every level of the workforce (Note: missing any one of them could set you up for a costly lawsuit) 
  • Design job descriptions that are measurable for performance management 
  • Explain how federal, state and local laws must be properly considered in the job description 
  • Describe general Best Practices for writing legally solid job descriptions 
  • Explain key issues surrounding The Americans with Disabilities Act of 1990, which impacts all job descriptions 
  • Revise job descriptions without falling into the most common traps that snare even the most conscientious HR executives and line managers.
ABOUT THE SPEAKER

Melissa Fleischer, Esq., is the Founder and President of HR Learning Center LLC, a human resources consulting firm specializing in employment law. Her firm provides training seminars and consulting on workplace and HR issues. Ms. Fleischer is a management-side employment attorney with over 20 years experience and is nationally recognized as an expert in her field.

Ms. Fleischer is a frequent lecturer on employment law topics including seminars and workshops on Anti-Harassment Training, FMLA/ADA Training and Workplace Violence Prevention Training. Ms. Fleischer is also a Chapter Editor for the new FMLA Treatise that has been recently published by BNA.

She is a member of SHRM and adjunct faculty providing employment law training for the Professional Development Center of SUNY/Westchester Community College in Valhalla, NY.
